Welcome to Booksify. These Terms of Service ("Terms") govern your access to and use of the Booksify mobile application ("App") and related services (collectively, the "Service"). Please read these Terms carefully before using our Service.
1. Acceptance of Terms
By downloading, installing, or using the Booksify App, you agree to be bound by these Terms of Service. If you do not agree to these Terms, you may not access or use the Service.
You represent that you are at least 13 years of age, or the age of majority in your jurisdiction, whichever is greater. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
We reserve the right to modify these Terms at any time. Your continued use of the Service following any changes constitutes acceptance of those changes.
2. Description of Service
Booksify is an audiobook streaming application that provides users with access to a library of audiobook content. The Service allows you to:
- Browse and discover audiobooks from our catalog
- Stream audiobooks directly within the App
- Download audiobooks for offline listening
- Create and manage personal libraries and playlists
- Track your listening progress across devices
- Access premium features through subscription plans
The availability of specific audiobooks may vary based on your subscription plan and geographic location. We reserve the right to add, modify, or remove content from the Service at any time.
3. User Accounts
Account Registration
To access certain features of the Service, you must create an account. When registering, you agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Keep your password confidential and secure
- Notify us immediately of any unauthorized access to your account
- Accept responsibility for all activities that occur under your account
Account Security
You are responsible for maintaining the confidentiality of your account credentials. We recommend using a strong, unique password and enabling any additional security features we may offer, such as Sign in with Apple.
We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe have been compromised.
4. Subscription and Payments
Subscription Plans
Booksify offers subscription-based access to premium content and features. Subscription plans, pricing, and features are displayed within the App and may be modified from time to time.
Apple App Store Billing
All subscriptions are processed through the Apple App Store. By subscribing, you agree to Apple's terms and conditions for in-app purchases. Payment will be charged to your Apple ID account upon confirmation of purchase.
Auto-Renewal
Important: Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
You can manage and cancel your subscription through your Apple ID account settings. Cancellation will take effect at the end of the current billing period.
Refunds
Refund requests are handled by Apple according to their refund policies. To request a refund, please contact Apple Support directly through the App Store.
5. Free Trial
Booksify may offer a free trial period for new subscribers. The current free trial period is 3 days.
Trial Terms: At the end of the free trial period, your subscription will automatically convert to a paid subscription, and your payment method will be charged unless you cancel before the trial ends.
- Free trials are available once per Apple ID
- You may cancel at any time during the trial period without charge
- To cancel, go to Settings > Apple ID > Subscriptions on your device
- Unused portions of the free trial will be forfeited upon subscription purchase
6. Content and Licensing
LibriVox Public Domain Content
A significant portion of the audiobook content available through Booksify is sourced from LibriVox, a volunteer-driven project that produces free public domain audiobooks. This content:
- Consists of recordings of literary works in the public domain
- Is created by volunteers and released into the public domain
- Is free for anyone to use, share, and redistribute
Content License
Subject to your compliance with these Terms and any applicable subscription requirements, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the content available through the Service for your personal, non-commercial use.
This license does not grant you any ownership rights in the content or the Service.
7. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:
- Use the Service in any way that violates applicable laws or regulations
- Attempt to gain unauthorized access to any part of the Service
- Interfere with or disrupt the Service or its servers
- Use automated systems or software to extract content from the Service (scraping)
- Redistribute, sell, or commercially exploit any content from the Service
- Remove, alter, or obscure any copyright or proprietary notices
- Share your account credentials with others
- Use the Service to transmit harmful code or malware
- Engage in any activity that could damage or impair the Service
Violation of these acceptable use provisions may result in immediate termination of your account and access to the Service.
8. Intellectual Property
Our Intellectual Property
The Booksify name, logo, and all related trademarks, service marks, and trade names are the property of Booksify. The App itself, including its design, features, and functionality, is protected by copyright, trademark, and other intellectual property laws.
Third-Party Content
While much of our audiobook content is in the public domain, certain elements such as cover art, descriptions, and metadata may be subject to third-party intellectual property rights.
User Feedback
Any feedback, suggestions, or ideas you provide regarding the Service may be used by us without any obligation to compensate you or maintain confidentiality.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- IMPLIED WARRANTIES OF MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- UNINTERRUPTED OR ERROR-FREE OPERATION
We do not warrant that:
- The Service will meet your specific requirements
- The Service will be available at all times or operate without interruption
- Any errors or defects will be corrected
- The Service is free of viruses or other harmful components
- The content is accurate, complete, or current
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BOOKSIFY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Any loss of profits, data, use, or goodwill
- Any damages resulting from unauthorized access to or use of our servers
- Any interruption or cessation of the Service
- Any bugs, viruses, or similar harmful code transmitted through the Service
In no event shall our total liability exceed the amount you paid, if any, for accessing the Service during the twelve (12) months preceding the claim.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Booksify operates, without regard to its conflict of law provisions.
Any disputes arising from or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration association, except where prohibited by law.
You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against Booksify.
12. Changes to Terms
We reserve the right to modify these Terms at any time. When we make changes, we will:
- Update the "Effective Date" at the top of this document
- Post the revised Terms within the App
- Notify you of material changes through the App or via email
Your continued use of the Service after any changes indicates your acceptance of the modified Terms. If you do not agree to the revised Terms, you must stop using the Service and cancel any active subscriptions.

Additional Provisions
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Booksify regarding the Service and supersede all prior agreements and understandings.
No Waiver
Our failure to enforce any right or provision of these Terms shall not be considered a waiver of such right or provision.
Assignment
You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
